Negatives, Transparencies & Digital media are the property of Eyewitness Photo Agency Ltd.

Sizes – All size are in inches and are approximate subject to trimming at our discretion.

Image Size – All images are presented in the following format: 6x8in & 8x10in (with white border).

Colour – Colour photography is undertaken within the technical limitation of the process. We shall undertake to produce a good skin tone.Subsequently other colours may not reproduce accurately.

Copyright – The copyright of all photographs are owned by Eyewitness Photo Agency Ltd. Any photograph may be reproduced by Eyewitness Photo Agency Ltd for publication, exhibition, display, competition or other promotional purposes. You may not copy, scan, or digitally reproduce any of our photographs.

Dyes – Because dyes used in photographic materials, like any other dyes, may change in time, prints are not warranted against any change in colour.

Complaints – In the event of any complaint, all work subject to complaint must be returned within three days together with appropiate invoice.

Delivery – Whilst delivery times will be adhered to wherever possible, they do not constitute part of the contract.

Liability – Our liability for loss or damage is limited to re-photographing, or refunding any monies paid.

Cancellation – We will charge 50% of our quoted shooting rate for assignments cancelled one week before assignment. If cancelled within three days of the assignment, the total fee will be payable.

Delivery ...
After the order has been received, the photo's are despatched within 48 hours. Normally, you will receive your photo's within 5 working days. Please note, during the Christmas period, delivery of photos can take up to 3 weeks.

Returns Policy ...
If your photo's are badly damaged in transit we will produce new ones and despatch them to you once the damaged ones are returned to us.

Video, Film and Multimedia Services

Payment – Total payment of £650 is a one off payment and due before the shoot date. The payment is non-refundable.

Booking Deposit – A deposit of 25% is required if the total cost of the booking is in excess of £2000. Dates are reserved only
when the deposit is paid. The deposit is non-refundable.

Balance Payment – The remaining balance is required no later than 7 days after the invoice date. The remaining balance would
include payments for photography and video coverage, DVD’s and any additional services. The balance payment is
non-refundable.

DVD’s – All additional DVD’s are subject to a charge and will only duplicate the original/primary DVD.

Video Output – Film and videography is undertaken within the technical limitation of the output process and may vary in colour from screen to screen.

Creative Licence – EyeWitness shall be granted creative and artistic licence in relation to the choice of sound, locations and
poses used. EyeWitness’s judgement on sound, video style and the amount of footage taken, shall be deemed correct. EyeWitness will do its best to honour requested video footage but do not undertake to guarantee any specific filming nor incorporate any specific background, location or group arrangement.

Creative Output – EyeWitness, the creator of the film/video/sound footage shall be granted full creative and artistic rights to
capture, edit, compose and output as they see fit. From capturing the footage to output, we reserve the right to produce and
deliver the finished DVD. Client feedback may be required.

Copyright – The1998 Copyright, Designs and Patents Act assigns copyright to EyeWitness. Any film and video may be
reproduced by EyeWitness for publication, exhibition, display, competition or other promotional purposes. You may not copy,
scan, or digitally reproduce any of our films or videos without prior notifcation and approval. Within the project brief, the client
will outline clearly their intentions of use and may use it for those purposes.

Film & Digital media are the property of EyeWitness.

Delivery – Whilst delivery times will be adhered to wherever possible, they do not constitute part of the contract. During the
festive seasons, for example Christmas (December), delivery times may take longer as it would during other peak times.

Liability – Our liability for loss or damage is limited to re-filming/re-producing.

Complaints – In the event of any complaint, all work subject to complaint must be returned within three days together with
appropriate letter.

Force Majeure – If due to unforeseen circumstances EyeWitness is unable to attend the booked day/s, EyeWitness will
endeavour to find a replacement cameraman/crew for the day/s. Failing to find a replacement cameraman/crew within the time
provided we shall refund all monies paid.

In the unlikely event of total photographic failure, injury or sickness beyond EyeWitness’s control, the liability shall be limited to a full refund of all monies paid. Your statutory rights are not affected.

Search Engine Optimisation & Digital Video Distribution

Payment – Payment is on a monthly basis and based on the package you select. Please set up a standing order with your bank.
The payment is non-refundable.

"We", "us", "our", "ours", "company" refers to EyeWitness and "you", "your", "customer", "client", refers to the users and buyer of goods and/or services from EyeWitness. We reserve the right to change our terms and conditions without prior notice and you agree to accept updated terms and conditions made by EyeWitness.

General Statement
We will give prior notice to our regular customers to refer to our new updated policy statement at every new purchase. Hence, at
every renewal or upgrade of packages, we will ask you to complete a new contract.

We ensure a 100% directory submission service but getting approved and listed in any particular directory is beyond our control.
A directory may revoke a submission at any given moment without any prior notice and this would be regarded as beyond our
control or responsibility.

We provide a link to the directory on behalf of our client and encourage the client to reviewing their privacy policy statement.
The client agrees that you do not have any right to blame us for any damage of your website, it's popularity, loss of money, loss of customer, loss of earnings or any loss incurred by commissioning EyeWitness and using its products or services.

A customer can not cancel their order/s once the order has been placed and we begin work. We are not legally liable to refund
any monies once they place the order and the work has commenced. The order can only be cancelled after the 9 months
submission period and payment terms is over.

Time Limitation
Completion time of an order can vary for the 3 packages and you will receive a report every 4 weeks until the submission is
completed. If any delays occur due to reasons beyond our control such as, your sites long description, title, directory approval or
any delay from network problems, then please be patient and bear with us.

The time taken by a directory editor to approve your website link is beyond our control and we can not guarantee an approval
time limit.

Others
EyeWitness is not liable for any loss of transaction, loss of popularity of your site, loss of customer, loss of data, loss of earnings
and any other loss incurred directly and/or indirectly from using our products or services.

You are agreeing that all rights are reserved to EyeWitness and accept all decision made by EyeWitness in any other condition.
